Unpaid Overtime Lawyers

Employers don't always play by the rules. Across the United States, employees in industries as different as agriculture, sales and technical support are regularly deceived, lied to and cheated out of wages and overtime pay that are due to them. Why? Sometimes it happens out of ignorance of the law. More frequently, it is due to greed. Bad employers know they have power over their employees, and they use it against them. At Briggle & Polan PLLC, we stand on the side of employees in Laredo and throughout the country whose employment rights have been violated. Using the power of the Fair Labor Standards Act (FLSA), we fight vigorously for bankers, loan officers, mortgage brokers, cable installers, computer/IT professionals, field service technicians and many other employees, in both individual and class action lawsuits.

LEADING THE FIGHT FOR FAIR EMPLOYEE WAGES.
Led by attorneys Hayden Briggle and Parker Polan at Briggle & Polan PLLC, we have won multimillion-dollar and six-figure jury verdicts and settlements on many complex litigation cases. We have a proven record of success in recovering money, getting justice and restoring dignity for their clients.

FREQUENTLY ASKED QUESTIONS

Answers to Your Pressing Questions

We have represented hundreds of clients. As a result, we recognize what is important to clients, what questions they typically have, and how to best protect their interest before, during, and after their lawsuit.

We handle all overtime cases on a contingency fee basis.

Wage and hour overtime statute of limitations is usually two years or less from the date that your wages should have been paid. In some cases, you may be able to recover up to three years of overtime wages if your employer willfully violated overtime laws.

The Fair Labor Standards Act (FLSA), also considered the federal Wage and Hour Law, regulates minimum wage, overtime, equal pay, recordkeeping, and child labor. Under the FLSA, employees are classified as either exempt or non-exempt from minimum wage and overtime. Note: Some states and local jurisdictions have their own wage and hour laws, which may provide greater protection for employees than what is provided under the FLSA. Where federal, state, and local laws conflict, the law that is most beneficial to the employee prevails.

Overtime pay (one and one-half times the regular hourly rate received) is due an employee after 40 hours of work in a workweek. Special exceptions apply with respect to certain professions and positions, such as police officers, managers, and hospital and nursing home employees.
